These Terms and Conditions apply to purchases made through loxleybindings.com and to commissions accepted directly by Loxley Bindings.
By placing an order or accepting a quotation for commissioned work, you agree to these Terms and Conditions.
2. Products and Services
Loxley Bindings provides handcrafted bookbinding products and services, including made-to-order books, custom print and binding, rebinding of existing books, presentation cases and related commissioned work.
Because our work is handmade, natural materials such as leather, cloth and marbled paper may show small variations in colour, grain, texture or pattern. These variations are characteristic of the materials and of handcrafted production and are not normally considered defects.
3. Orders and Payment
Products available through our online store are paid for at checkout using the payment methods offered on the website.
Bespoke commissions may instead be agreed directly with Loxley Bindings. The specification, price, deposit, payment schedule and anticipated production period will be confirmed in writing before the commission proceeds.
A quotation is based on the specification provided at the time. Any subsequent changes requested by the customer may affect the price and completion date.
For bespoke work, production will normally begin only after any required deposit or payment has been received and the relevant specification or design has been approved.
4. Made-to-Order and Bespoke Work
Many Loxley Bindings products are made to order rather than held as finished stock.
Production times vary according to the product and our current workload. The estimated lead time shown on the relevant product page, quotation or written order confirmation forms part of the agreed order.
For bespoke commissions, design details, materials and other specifications may be agreed by email or other written correspondence. Once a design or specification has been approved and production has begun, changes cannot always be accommodated. Where a change is possible, additional costs or production time may apply.
Any date that is essential to the customer must be agreed with Loxley Bindings before the order is placed.
5. Customer-Supplied Books, Files and Artwork
Where a customer supplies an existing book for rebinding, the customer is responsible for arranging its safe delivery to Loxley Bindings unless otherwise agreed.
Existing or older books can contain concealed weaknesses or previous repairs that only become apparent once the original binding is removed. If significant unforeseen issues are discovered, we will contact the customer before carrying out work materially outside the agreed specification.
Where customers provide manuscripts, PDFs, artwork, illustrations, logos or other material for reproduction, they confirm that they own the necessary rights or have permission to use and reproduce that material.
Copyright in customer-supplied material remains with its existing rights holder.
6. Shipping and Delivery
In-stock products will normally be dispatched within 2–3 business days unless otherwise stated.
Made-to-order and commissioned products will be dispatched after production has been completed in accordance with the estimated lead time provided with the order.
Delivery is arranged using an appropriate postal or courier service, usually Royal Mail or UPS.
Where Loxley Bindings arranges delivery to a consumer, responsibility for the item remains with Loxley Bindings until it has been delivered to the customer or another person nominated by them.
International customers are responsible for any import duties, customs charges or local taxes applied by the destination country unless expressly stated otherwise at checkout.
Customs processing is outside our control and may occasionally delay international deliveries.
7. Cancellation and Returns
For standard products purchased online, including standard designs that are made to order but are not personalised or made to the customer's individual specification, customers normally have the right to cancel their purchase within 14 days after receiving the goods.
Customers must tell us that they wish to cancel within that period and must return the goods within a further 14 days.
Unless the goods are faulty, damaged or incorrectly supplied, the customer is responsible for the cost of returning them.
Returned goods should be appropriately packaged and returned in substantially the same condition in which they were received. We may make a reasonable deduction from a refund where handling beyond what would reasonably be permitted when examining goods has reduced their value.
Where a valid cancellation applies, we will refund the purchase price together with the cost of our standard delivery option. If a customer selected a more expensive delivery service, we are not required to refund the additional delivery cost.
8. Personalised and Bespoke Goods
The statutory right to cancel for a change of mind does not normally apply to goods made to the customer's individual specifications or which are clearly personalised.
This may include, for example, books incorporating customer-specific titling, artwork, dimensions, materials, printed content or other individually agreed design features.
Where possible, Loxley Bindings may agree to cancellation of a bespoke commission before significant work or expenditure has begun. Any amount retained following cancellation will reflect work already undertaken, materials specifically obtained for the commission and other reasonable costs or losses resulting from the cancellation.
Nothing in this section affects the customer's statutory rights where goods are faulty, damaged, misdescribed or otherwise do not conform to the contract.
9. Commissioned Services
Some commissions, particularly rebinding work involving a customer's existing book, include the provision of a service.
Where a customer expressly asks Loxley Bindings to begin providing a service during any applicable statutory cancellation period, work may begin at the customer's request.
If the customer subsequently exercises a legal right to cancel before that service has been completed, they may be required to pay a reasonable amount for work already performed up to the date of cancellation.
10. Faulty or Damaged Goods
Loxley Bindings will supply goods that are of satisfactory quality, fit for their intended purpose and as described, and will perform binding services with reasonable care and skill.
If an item arrives damaged, is faulty or differs materially from the agreed specification, please contact us as soon as reasonably possible with details and photographs where appropriate.
Your statutory consumer rights are not affected by these Terms and Conditions.
11. Intellectual Property
Loxley Bindings retains copyright and other intellectual property rights in original binding designs, artwork, templates, photographs and other creative material produced by Loxley Bindings, unless otherwise agreed in writing.
This does not give Loxley Bindings ownership of a customer's manuscript, artwork, book content or other intellectual property supplied by the customer.
12. Privacy
Personal information provided in connection with an enquiry or order is handled in accordance with our Privacy Policy.
Information may be provided to service providers where necessary to process payments, administer orders or arrange delivery.
13. Prices and Tax
Prices are stated in pounds sterling unless otherwise indicated.
Loxley Bindings is not currently registered for UK VAT and therefore does not add UK VAT to its prices.
International customers may be required to pay customs duties, import taxes or similar charges imposed by authorities in their own country.
14. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
Nothing in these Terms is intended to restrict any mandatory consumer rights that apply under relevant law.
15. The Contract Between Us
These Terms and Conditions, together with the relevant product description, quotation, invoice, approved specification or design and any written correspondence recording agreed changes, form the agreement between Loxley Bindings and the customer.
If there is an inconsistency, an individually agreed written specification or quotation will take precedence over a general description in these Terms where appropriate.
16. Changes to These Terms
We may update these Terms and Conditions from time to time.
Changes will apply to orders placed after the revised Terms are published. Orders already accepted will remain subject to the terms and specifications agreed when the order was accepted unless we and the customer agree otherwise.
